Arabian American Oil Co., that Title VII of the Civil Rights Act of 1964, the federal statute which makes it illegal for employers to discriminate on the basis of race, color, religion, sex, and national origin, did not apply extraterritorially to regulate the employment practices of United States employers that discriminate against United States citizens abroad.   However, as The U.S. Equal Employment Opportunity Commission notes in the Enforcement Guidance memorandum, Congress subsequently amended both Title VII and the Americans with Disabilities Act in 1993 to permit American citizens employed outside of the United States by an American employer or a foreign corporation controlled by an American employer to pursue legal claims. Today, Feb 7 2012, The OFCCP has posted the following supplementary information related to its December 9, 2011 related to comments on its NPRM on Section 503. It might be interesting to check this out if you are a government contractor with questions or concerns about the new proposal and initiative to hire more persons with disabilities. On December 9, 2011, OFCCP published a proposed rule entitled, "Affirmative Action and Nondiscrimination Obligations of Contractors and Subcontractors Regarding Individuals with Disabilities" (76 FR 77056). OFCCP was to receive comments on this NPRM on or before February 7, 2012. Various organizations and entities submitted requests to extend the comment period by an additional 90 days or more. FMLA, the Family Medical Leave Act is a law that governs the right for employees to take leave, for maternity leave, care for a sick child, spouse or parent and also for the care of injured military personnel who are employees within the workforce.
